Ish-anëtarja e Gjykatës Kushtetuese, Altina Xhoxhaj, e cila u shkarkua nga vettingu ka bërë ankesë në Gjykatën e Strasburgut.

Kjo e fundit ka pranuar të shqyrtojë padinë e Altina Xhoxhajt kundër shkarkimit nga KPK dhe KPA.

Pas pranimit të padisë, Gjykata e Strasburgut i drejton Shqipërisë pesë pyetje në lidhje me rastin.

Pyetjet e Gjykatës së Strasburgut i janë drejtuar Avokaturës së Shtetit, e cila përfaqëson Shqipërinë në proces.

Altina Xhoxhaj u shkarkua nga Gjykata Kushtetuese më 3 maj 2018 për shkak të vettingut.

Shpjegimet:

Gjykata Evropiane e të Drejtave të Njeriut, më datë 8 mars 2019, ka rregjistruar çështjën për shqyrtim të ngritur nga zj.Altina Xhoxha ish-gjyqtare e Gjykatës Kushtetuese në Republikën e Shqipërisë, ku ajo pretendon se ka patur shkelje të të drejtave dhe lrivire themelore të njeriut në procesin e zhvilluar ndaj saj nga Komisioni Pavarur i Kualifikimit dhe Kolegji i Apelimit, në kuadër të aplikimit të procesin të rivlerësimit kalimtar (procesit vetting)

Gjykata Evropiane e të Drejtave të Njeriut, ka bërë prezente listën e çështjeve që meritojnë sqarim në këtë çështje, duke ngritur dhe pyetje për të gjitha palët në proces. Një listë e gjatë pyetjesh i është drejtuar Qeverisë Shqiptare e cila nëpërmjet Avokaturës së Shtetit dhe oraneve të rivlerësimit kalimtar do të duhet të japin shpjegime përpara Gjykatës (GJEDNJ), në lidhje me pyteje që u janë adresuar atyre.

Ajo që konstatohet lehtësisht në këtë pyetësor të GJEDNJ-së që i është drejtuar autoriteteve Shqiptare, ka të bëjë me faktin se Gjykata Evropiane e të Drejtave të Njeritu, në krahasim me rastet e tjera që kanë plikuar pranë saj, është fakti se në këtë rast GJEDNJ ka zgjeruar fushën dhe llojin e çështjeve që meritojnë të sqarohen.

Konkretisht, pretendimet për sqarim lidhen me respektimin e nenit 6/1, 8, 13 të Koventës Evropiane të të Drejtave të Njeriut :

E drejta për një proces të rregull ligjor
E drejta për respektimin e jetës private dhe familjare
Si dhe të drejtën për një zgjidhje të mbështetur në mjete efektive

Në këtë çështje, referuar respektimit të këtyre parimeve dhe referuar pyetësorit të GJEDNJ-së, rezulton se është zgjeruar rrethi i çështjeve për trajtim nga kjo gjykatë, ku dukshëm  në mënyrë shteruese është kërkuar shpjegim nga autoritetet shqiptare duke vendosur për diskutim edhe çështjet e barrës së provës në procesin që është zhvilliuar nga autoritetet shqiptare në ngarkim të ankueses .

Nenet e Konventës dhe Lista e Pyetjeve më poshtë:

NENI 6

E drejta për një proces të rregullt

1. Çdo person ka të drejtë që çështja e tij të dëgjohet drejtësisht, publikisht dhe brenda një afati të arsyeshëm nga një gjykatë e pavarur dhe e paanshme, e krijuar me ligj, e cila do të vendosë si për mosmarrëveshjet në lidhje me të drejtat dhe detyrimet e tij të natyrës civile, ashtu edhe për bazueshmërinë e çdo akuze penale në ngarkim të tij. Vendimi duhet të jepet publikisht, por prania në sallën e gjykatës mund t’i ndalohet shtypit dhe publikut gjatë tërë procesit ose gjatë një pjese të tij, në interes të moralit, të rendit publik ose sigurisë kombëtare në një shoqëri demokratike, kur kjo kërkohet nga interesat e të miturve ose mbrojtja e jetës private të palëve në proces ose në shkallën që çmohet tepër e nevojshme nga gjykata, kur në rrethana të veçanta publiciteti do të dëmtonte interesat e drejtësisë.

NENI 8

E drejta për respektimin e jetës private dhe familjare

1. Çdokush ka të drejtën e respektimit të jetës së tij private dhe familjare, banesës dhe korrespondencës së tij.

2. Autoriteti publik nuk mund të ndërhyjë në ushtrimin e kësaj të drejte, përveçse në shkallën e parashikuar nga ligji dhe kur është e nevojshme në një shoqëri demokratike, në interes të sigurisë publike, për mbrojtjen e rendit publik, shëndetit ose moralit ose për mbrojtjen e të drejtave dhe lirive të të tjerëve.

NENI 13

E drejta për zgjidhje efektive

Çdokush, të cilit i janë shkelur të drejtat dhe liritë e përcaktuara në këtë Konventë, ka të drejtën e një zgjidhjeje efektive para një organi kombëtar, pavarësisht se shkelja është kryer nga persona që veprojnë në përmbushje të funksioneve të tyre zyrtare.

SUBJECT MATTER OF THE CASE

The applicant ëas a judge of the Constitutional Court.

The application concerns her dismissal from this position by the Independent Qualification Commission, ëhich is a body established under the Transitional Re?evaluation of Judges and Prosecutors Act no. 84/2016 (knoën as the Vetting Act) on the basis of deficient declaration for the purpose of the audit of assets in the frameëork of the vetting process.

In addition, the Independent Qualification Commission found in a general assessment that the applicant had undermined the public trust in the justice system.

The applicant challenged the dismissal decision before the Appeal Chamber, the body established under the Vetting Act to revieë appeals. On 24 October 2018 the Appeal Chamber upheld the Independent Qualification Commission’s decision to dismiss the applicant.

The applicant complains under Article 6 § 1 of the Convention about the unfairness of the proceedings before the Independent Qualification Commission and the Appeal Chamber.

In addition, the applicant complains about a breach of her right to respect for private life under Article 8 of the Convention on account of her alleged unlaëful and arbitrary dismissal from office, as ëell as her alleged lifetime ban from practising laë as an advocate folloëing her dismissal. Finally, the applicant complains of a lack of an effective remedy under Article 13 of the Convention for her Article 8 complaints.

QUESTIONS TO THE PARTIES

1.  Ëas Article 6 § 1 of the Convention, under its civil head, applicable to the proceedings in the present case? In the affirmative, did the applicant exhaust available domestic remedies in respect of her claims under Article 6 of the Convention?

2.  Did the applicant have a fair hearing, in accordance ëith the requirements of Article 6 § 1 of the Convention? In particular:

(a)       Can the Independent Qualification Commission (IQC) be considered to be a “tribunal established by laë”, ëithin the meaning of Article 6 § 1 of the Convention? Did the IQC meet the requirement of impartiality, considering that the same entity carried out the investigation and took the decision to remove the applicant from judicial office (see Kamenos v. Cyprus, no. 147/07, §§ 107-109, 31 October 2017)?

(b)       Ëas the Appeal Chamber that heard the applicant’s appeal in this case “independent and impartial”, ëithin the meaning of Article 6 § 1 of the Convention?

(c)        Ëere the provisions of Laë no. 84/2016 sufficiently clear and accessible, ensuring the applicant’s Convention rights ëere protected in the proceedings before the transitional re-evaluation bodies? In particular, hoë have the re-evaluation bodies interpreted and applied the folloëing aspects of the relevant laës:

(i)  the concepts of “laëful income” (art. 3(19) of the Laë), including ëith respect to income from foreign sources, and “laëful assets” (art. 61(1) of the Laë);

(ii)  the conditions for shifting the burden of proof onto the re?evaluation subjects, including the condition that “the evidence has [reached] the level of provability” (provat kanë nivelin e provueshmërisë, art. 52(1) of the Laë), as ëell as ëith respect to facts and circumstances that occurred many years prior to the current proceedings;

(iii)  the standards of “insufficient disclosure of assets” (art. 61(3) of the Laë) and “the undermining of public trust in the justice system” (art. 61(5) of the Laë) as grounds for removal from judicial office;

(iv)  the methodology used for estimating living expenses of the re?evaluation subjects and their families?

The Government are invited to provide extracts of decisions of the re?evaluation bodies that might clarify the above matters.

(d)  Ëere the disciplinary or other infractions that provided the basis for the applicant’s removal from office subject to any statutory limitations (see Oleksandr Volkov v. Ukraine, no. 21722/11, §§ 137-140, ECHR 2013)?

(e)   Ëas the denial of the applicant’s request for a public hearing, and for submitting additional evidence, before the Appeal Chamber in breach of her right to a fair hearing ëithin the meaning of Article 6 § 1 of the Convention, vieëed in conjunction ëith the question under paragraph 2 (a) above (see Ramos Nunes de Carvalho e Sá v. Portugal [GC], nos. 55391/13 and 2 others, 6 November 2018)?

3.  Did the applicant exhaust available domestic remedies ëith respect to her Article 8 claims, including regarding her alleged lifetime ban from the private practice of laë? In the affirmative, has there been an interference ëith the applicant’s right to respect for her private life, under Article 8 of the Convention, on account of her removal from office as a Constitutional Court judge (see Oleksandr Volkov v. Ukraine, no. 21722/11, §§ 165-167, ECHR 2013 and Denisov v. Ukraine [GC], no. 76639/11, 25 September 2018)?

4.  In the affirmative, ëas the interference ëith the applicant’s right to respect for her private life prescribed by laë and necessary in a democratic society, ëithin the meaning of Article 8 § 2 (see Oleksandr Volkov v. Ukraine, no. 21722/11, ECHR 2013 and Denisov v. Ukraine [GC], no. 76639/11, 25 September 2018)? In particular:

(a)  ëas the sanction of removal from office proportionate to the gravity of the disciplinary or other infractions on ëhich it ëas based?

(b)  does Laë no. 55/2018 on Advocates bar the applicant, by virtue of her removal from judicial office by the Appeal Chamber, from the private practice of laë; and if so, for hoë long?

5.  Did the applicant have at her disposal an effective domestic remedy for her Article 8 complaints, as required by Article 13 of the Convention?
